The day of opening, the City attended a shop displaying tobacco products, including cigarettes and vape products.
The issue crosses federal, state and local government jurisdictions. The City notified appropriate authorities, including the Department of Health’s Tobacco Control , responsible for the compliance of the sale, display and licencing of tobacco.
The City’s role related to land use in accordance with the Local Planning Scheme No. 5, in that the store was considered to a be Restricted Premises.
At last night’s Council Meeting, Council authorised the CEO to commence prosecution if it was found the unlawful use of the premises continued or recommenced.
The City understands the store is now closed and therefore no further action is required, at this time.
