Local Public Notice: Burley Lane, Subiaco

The City gives notice that it proposes to dispose of property at Burley Lane, Subiaco by sale. The City invites submissions in relation to the sale. Submissions must be made in writing by 5pm 9 April 2026.

At its Ordinary Council Meeting on Tuesday, 24 March 2026 the City of Subiaco Council resolved to advertise its intention to sell a portion of Burley Lane to Sirona Urban – a requirement when selling Council owned land.
 
The potential sale is intended to facilitate the redevelopment and protection of key heritage buildings at 424-428 and 440 Hay Street in the centre of Subiaco, which are currently boarded up and in a state of disrepair. Burley Lane is a small right of way adjacent to the heritage buildings.
 
City of Subiaco Mayor David McMullen said, “Our planning framework can generously accommodate a renewal of the Hay Street lots, and we have consistently said that we wish for this potential to be realised with a high-quality development that celebrates the heritage in the existing buildings.
 
Hence, this month's Council resolution – which states that any sale will be conditional upon a grant of planning approval; and the buyer must retain, preserve, restore, conserve and adapt the heritage buildings at 424-428 and 440 Hay Street, Subiaco WA in a way which maintains their cultural significance in accordance with the Burra Charter 2013.”
 
The advertised portion of Burley Lane is approximately 300sqm, to the east of Sagar Lane. The advertised price is $840,000.00.
 
Mayor McMullen said, “The heritage buildings 424-428 and 440 Hay Street have a long history. The City has spent years working to prevent their demolition and to ensure that they have not been allowed to fall into complete disrepair.
  
“The advertised proposal to sell a portion of Burley Lane is not automatic approval of any development. The notice approved by Council includes a reminder that the City is not restricting or fettering its discretion, or the exercise of its functions as a local government. Any redevelopment proposal will need to go through a planning approvals process.”

The vehicle and pedestrian access rights for adjoining landowners across the length of Burley Lane remain, regardless of ownership. Burley Lane will continue to be used as it is today, with development occurring above Burley Lane.
