Have your say on proposed Waylen Road scheme amendment

The City of Subiaco is inviting community feedback on a proposed amendment to Local Planning Scheme No. 5 (Amendment No. 5) relating to 37 Waylen Road, Shenton Park.

Amendment No. 5 proposes changing the residential density of the property from R15 to R100. It is a private scheme amendment – meaning it is being proposed by a landowner, not the City. No changes are proposed to the density of surrounding properties. 

The proposed R100 coding could allow the property to be developed at a higher density, including townhouses or apartments, subject to the applicable planning requirements and any future development approval.

The City is advertising the amendment following a direction from the Minister for Planning under section 76 of the Planning and Development Act 2005.

The direction requires the City to progress the amendment through the statutory scheme amendment process. Advertising the amendment does not indicate that Council or the Minister supports the proposal.

The City has an established, strategic approach to accommodating growth through its contemporary planning framework, which the Western Australian Planning Commission has recognised as achieving the City’s residential density targets set by the state government.

This is the third time a proposed density change affecting 37 Waylen Road has been considered by Council:

  • In May 2022, Council considered Amendment No. 2, which proposed changing the density coding of 15 properties within the street block bounded by Waylen Road, Railway Road, Morgan Street, and Fortune Street. Council resolved not to initiate the amendment.

  • The original Amendment No. 5, submitted on behalf of the owners of 37 Waylen Road in November 2024, applied only to that property and proposed changing its residential density from R15 to R60. Council considered the proposal in March 2025 and resolved not to initiate it.

  • In May 2026, the Minister directed the City to initiate a modified version of the amendment proposing an R100 density. Council subsequently resolved at its July 2026 meeting to initiate the amendment in accordance with the direction, and the Minister granted approval for it to be advertised on 31 August 2026.

Residents in the street block were notified about the Ministerial direction in June 2026. A copy of the notification is available on the City’s website.

Submissions open at 9am on Friday 11 September and close at 5pm on Wednesday 11 November 2026.

Community members can review the amendment documents, frequently asked questions, and information about how to make a submission on the Have Your Say Subiaco page.

Following consultation, City officers will consider all submissions and prepare a report for Council. Council may recommend supporting the amendment, supporting it with modifications, or not supporting it.

The amendment, Council’s recommendation, and all submissions will then be forwarded to the Western Australian Planning Commission for consideration. The Minister for Planning will make the final decision.
